The Court reiterated that the recording of satisfaction that the accused is not guilty and is not likely to commit any offence while on bail is a jurisdictional prerequisite for granting bail in commercial quantity cases, and the right to speedy trial under Article 21 cannot override the special statutory framework. The Court also noted that the High Court had recorded that the respondent had no other case, contrary to his own admission of a previous FIR. The appeal was allowed, and the respondent was directed to surrender.
