Synopsis of the Judgment

The appellant (T. Gnanavel) was promoted as Assistant Engineer notionally from 14.04.1997 and placed above Town Planning Inspectors (including respondent R. Sasipriya) by G.O. (D) No. 19 dated 18.01.2005, based on G.O. Ms. No. 237 dated 26.09.1996 which merged Engineering and Town Planning Departments. Respondent challenged the G.O.; single judge dismissed the writ petition, but Division Bench allowed the appeal, set aside the G.O., and directed scrutiny of files. The Supreme Court reversed, holding that the policy decision in G.O. Ms. No. 237 was never challenged, the promotions were pursuant to court orders, a committee had found no irregularities, and the respondent had retired after receiving promotions to higher posts. Impleading applicants (fence-sitters) were denied relief. The G.O. was restored, and subsequent promotions were held valid.
