Synopsis

The appellant, accused under the Unlawful Activities (Prevention) Act, 1967 (UAPA) and the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act), had been in custody for over five years and eleven months. The Special NIA Court and the High Court rejected his bail application. The Supreme Court granted bail, holding that prolonged incarceration coupled with the unlikelihood of trial concluding in the near future overrides the statutory embargo under Section 43-D(5) of the UAPA. The Court reaffirmed that the three‑Judge Bench decision in K.A. Najeeb is binding law: the rigours of Section 43-D(5) “melt down” where there is no likelihood of timely trial and the accused has already served a substantial part of the prescribed sentence. The Court also clarified that the decisions in Gurwinder Singh and Gulfisha Fatima, which attempted to dilute Najeeb, were contrary to judicial discipline as they were rendered by smaller benches without referring the matter to a larger bench. The Court further relied on the abysmal conviction rate under the UAPA (2‑6% nationally, less than 1% in Jammu & Kashmir) to emphasise that continued pre‑trial detention is constitutionally impermissible.
