Legal Analysis : The Commissioner, Bruhat Bangalore Mahanagara Palike v. K.K. Umesh Kumar & Ors

Citation: 2026 INSC 637

Court: Supreme Court of India

Bench: A Division Bench comprising Justice Sanjay Karol & Justice Nongmeikapam Kotiswar Singh

Date of Decision: June 11, 2026

Nature of Judgment: Civil Appeal arising out of SLP (C) No. 1039 of 2021 against the judgment of the High Court of Karnataka at Bengaluru.

Synopsis of the Judgment

The respondent no.1 was travelling in an auto-rickshaw when due to heavy rain, the vehicle was pulled over to the side of the road and stopped under a roadside tree. A branch of the tree, which was stated to be nearly a hundred years old, detached and fell on the auto-rickshaw, causing grievous injuries to the respondent including total paraplegia of both lower limbs with bladder and bowel incontinence. The Motor Accidents Claims Tribunal dismissed the claim petition treating it as a natural calamity. The High Court of Karnataka, in the second round of proceedings after remand by the Supreme Court, allowed the claim and awarded Rs.17,10,500/- with apportionment of liability – 25% by the Municipal Corporation (appellant herein), 50% by the Insurer of the auto-rickshaw, and 25% by the Horticulture Department, Government of Karnataka. The Supreme Court held that the appellant-Municipal Corporation could not be held liable under the Motor Vehicles Act, 1988 because the falling of the tree branch was not an accident "arising out of the use of a motor vehicle" – the motor vehicle did not play an active role in the accident. However, exercising power under Article 142 of the Constitution, the Court enhanced the total compensation to Rs.25,00,000/- (with interest as determined by the High Court) while leaving the apportionment of liability undisturbed, so that the injured respondent does not suffer further delay in receiving compensation.
