Judgment in Brief

The Supreme Court dismissed the appeal and upheld the concurrent findings of the Family Court and the High Court that Clause 9 of the Settlement Petition, which required the husband to pay 20% of his annual income towards maintenance of the minor son, stood satisfied and ceased to operate upon payment of the lump sum amount under Clauses 8 and 10 of the settlement. The Court held that Clauses 8, 9, and 10 constitute a single interlocking arrangement, not three independent obligations. Clause 8 fixed the total quantum of maintenance, Clause 9 provided an interim income-linked mechanism pending payment of the first tranche, and Clause 10 marked the point of discharge. The Court rejected the wife's contention that Clause 9 was an independent and continuing obligation. The husband had paid the entire lump sum of ₹2.20 crore and had additionally deposited ₹1 crore (voluntarily relinquished) for the son's higher education.
